These terms apply when you visit clearityplugs.com (the "site") or buy from us. "Clearity", "we", "us" and "our" mean Clearity Earplugs, a sole proprietor based in California. "You" means anyone using the site or placing an order.

By using the site or placing an order, you agree to these terms. If you don't agree, please don't use the site.

1. Who can buy

  • You must be at least 18, or have a parent or guardian's permission to use the site and place an order.
  • We sell to customers around the word and ship worldwide.
  • You agree to give us accurate information when you order, including your name, email, shipping address and payment details.

2. Products and descriptions

  • We try to describe and show our products accurately. Colors can look different on different screens, and packaging may change.
  • Noise reduction figures we list are measured under test conditions. How much sound is reduced for you depends on fit, ear shape, ear tip size and how the earplugs are worn.
  • We may change or discontinue products at any time.

3. Product disclaimer: please read

  • Clearity earplugs are not a medical device. They are a consumer product that lowers the volume of sound reaching your ears.
  • We make no claim that they prevent, treat, cure or reverse hearing loss, tinnitus or any other condition. They reduce sound levels. They don't make loud environments safe, and they don't remove all risk of hearing damage.
  • Follow the fit instructions that come with the product and on our site. Earplugs that are not inserted correctly, or worn loosely will block less sound.
  • Use common sense: don't insert them too deep, don't share them, keep them clean, and stop using them if they cause pain, irritation or discomfort.
  • Stay aware of your surroundings. Earplugs reduce sounds like alarms, traffic and voices. Don't wear them where you need to hear warnings, such as while driving or cycling, unless it is safe and legal to do so.
  • Small parts: keep earplugs away from children and pets. They can be a choking hazard.
  • If you have ear pain, ringing in your ears, hearing changes or any other concern about your hearing, see a doctor or audiologist. Nothing on our site is medical advice.

4. Prices and payment

  • Prices may change at any time, but a change won't affect an order we've already confirmed.
  • Sales tax is added at checkout where required.
  • Payments are processed by Shopify and its payment partners. We don't store your full card details.
  • If a product is listed at a clearly wrong price because of an error, we may cancel the order and refund you in full, even after you've received an order confirmation.

5. Orders

  • Your order is an offer to buy. We accept it when we ship it.
  • We may refuse or cancel any order, for example if a product is out of stock, we suspect fraud, or there's a pricing error. If we cancel, we'll refund what you paid.
  • We may limit quantities per customer.

6. Shipping

  • We ship worldwide. Our products ship from more than one location, so items in one order may arrive separately.
  • Delivery times shown at checkout are estimates, not guarantees.
  • Risk of loss passes to you when the order is delivered to the carrier, but our refund policy still covers orders that are lost or arrive damaged.

7. Returns, refunds and replacements

Returns, refunds, cancellations, lost-plug replacements and shipping problems are covered by our Refund policy. That policy is part of these terms. If anything on this page seems to conflict with it, the refund policy wins.

8. Your account

If you create an account, keep your login details private. You're responsible for activity on your account. Tell us right away at [clearitypearplugs@gmail.com] if you think someone else has used it.

9. Reviews and content you send us

  • If you post a review, photo or comment on our site or send us feedback, you confirm it's yours to share and is honest.
  • You give us permission to use, display and share it (including in marketing) without payment. We won't use your full name without your permission.
  • We may remove content that's offensive, misleading, unlawful or off-topic.

10. Acceptable use

You agree not to:

  • use the site for anything illegal or fraudulent
  • try to hack, overload or disrupt the site
  • scrape, copy or resell our content or products without our written permission
  • pretend to be someone else

11. Intellectual property

The Clearity name, logo, product photos, text and site design belong to us or our licensors. You can't use them without our written permission, except to share links to our site.

12. Third-party links and services

Our site may link to other sites or use third-party services (such as payment and shipping providers). We're not responsible for their content or practices, and their own terms apply.

13. Privacy

How we collect and use your information is explained in our Privacy policy.

14. Warranty disclaimer

Apart from what our refund policy promises, the site and our products are provided "as is" and "as available". To the fullest extent the law allows, we don't make any other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. Some states don't allow these exclusions, so some of this may not apply to you.

15. Limitation of liability

To the fullest extent the law allows:

  • We aren't liable for any indirect, incidental, special or consequential damages arising from your use of the site or our products.
  • Our total liability for any claim related to an order is limited to the amount you paid for that order.

This doesn't limit liability that can't be limited by law, such as liability for death or personal injury caused by our negligence. Some states don't allow these limits, so they may not apply to you.

16. Indemnity

If you break these terms or misuse our products or site, and that leads to a claim against us, you agree to cover our reasonable costs from that claim, including legal fees.

17. Governing law and disputes

  • These terms are governed by the laws of the State of [State], without regard to its conflict-of-law rules.
  • Please contact us first. Most problems can be sorted out by email.
  • If we can't resolve it, any dispute will be handled in the state or federal courts located in Orange County, CA except that either of us may bring a claim in small claims court where we qualify.

18. Changes to these terms

We may update these terms from time to time. The "Last updated" date at the top shows when. Changes apply to orders placed after the update.

19. General

  • If any part of these terms is found unenforceable, the rest still applies.
  • If we don't enforce a right immediately, we haven't given it up.
  • These terms, together with our refund policy and privacy policy, are the full agreement between you and us about the site and your orders.
  • Nothing in these terms affects any rights you have under the law where you live.
